A class action judgment was granted against the former ‘foreclosure king’ David J. Stern for unlawful foreclosure practices. Florida borrowers will now share in $831, 110 of the class action award. Since there are over 1000 class member of the suit, the individual payout will range from around $400-$3000. More than the money awarded, the homeowners involved were pleased that this is the first real consequence any of those who were responsible for overcharging homeowners for legal services and unlawful actions.
Specific claims that were made include charging borrowers for future loan payments and future attorney fees. Additionally, Stern’s office reportedly filed separate and additional summons that were not necessary for the case, and charged the borrower accordingly. Believed to be the first successful class action lawsuit against Stern, experts feel as if it is sending a powerful message on the consequences of abusing power.
